Mandatory Acceptance

By purchasing a membership, booking, event, guest pass, merchandise package that includes facility access, or any other product or service through this Shopify store, the purchaser acknowledges and agrees to the following terms and conditions.

Assumption of Risk

The Member understands and acknowledges that participation in golf simulation, racing simulation, flight simulation, karaoke activities, gaming activities, club events, tournaments, training sessions, and the use of any equipment or facilities operated by LiDAR Golf Corporation involves inherent risks, including but not limited to:

• Slips, trips, and falls.
• Injury from swinging golf clubs.
• Injury from golf balls, simulator projectiles, or ricochets.
• Equipment malfunction.
• Physical exertion or repetitive motion injuries.
• Interactions with other participants or guests.
• Food and beverage-related incidents.
• Any other risks associated with recreational and entertainment activities.

The Member voluntarily assumes all such risks on behalf of themselves and their invited guests.

Release of Liability

To the fullest extent permitted by applicable law, the Member releases, waives, and discharges LiDAR Golf Corporation, its directors, officers, employees, contractors, volunteers, affiliates, landlords, and representatives from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising from:

• Personal injury.
• Illness.
• Property damage.
• Property loss.
• Death.
• Economic loss.

whether caused by negligence or otherwise, except where prohibited by law.

Mandatory Guest Waivers

The Member acknowledges that every guest they invite to the facility must complete and sign the current LiDAR Golf Corporation Liability Waiver and Assumption of Risk Agreement before entering any simulator bay, gaming area, karaoke room, racing simulator, flight simulator, practice area, or participating in any club activity.

Member Responsibility for Guests

The Member agrees that:

• They are solely responsible for ensuring their guests complete all required waivers before participation.
• They will not permit any guest to participate unless the guest has signed the required waiver.
• They will ensure guests comply with all facility rules, policies, safety instructions, and staff directions.
• They accept responsibility for any damage caused by their guests to club property, equipment, fixtures, furnishings, software, or leased premises.
• They may be charged for repair or replacement costs arising from damage caused by themselves or their guests.

Refusal of Access

LiDAR Golf Corporation reserves the right to:

• Refuse admission to any person who has not completed a required waiver.
• Remove any participant or guest who violates club rules or safety requirements.
• Suspend or terminate memberships for repeated violations of waiver or guest policies.

Indemnification

The Member agrees to indemnify and hold harmless LiDAR Golf Corporation from any claim, lawsuit, demand, loss, liability, damage, cost, or expense, including reasonable legal fees, arising from:

• The actions or omissions of the Member.
• The actions or omissions of any guest invited by the Member.
• Failure of the Member to ensure guest compliance with waiver requirements and club policies.

Electronic Acceptance

By checking the acceptance box during checkout and completing a purchase through this Shopify store, the purchaser confirms that:

1. They have read and understood these terms.
2. They voluntarily agree to be bound by them.
3. They understand they are waiving certain legal rights.
4. They agree to ensure all guests complete the required waiver before participation.
